Please read these Terms carefully. By making a booking with Lairsea Travel & Tours Limited, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
These Terms & Conditions ("Terms") govern the relationship between Lairsea Travel & Tours Limited ("Lairsea", "we", "us", "our"), registered in Kenya and operating from View Park Towers, 18th Floor, Utalii Lane, Nairobi, and you ("the client", "you", "your") when you use our travel booking and advisory services.
By submitting a booking request, making a payment, or otherwise engaging our services, you confirm that you have read, understood, and agree to these Terms on behalf of yourself and all members of your travel party.
Lairsea Travel & Tours Limited acts as a travel agent and tour operator, providing the following services:
When acting as an agent (for airlines, hotels, and third-party operators), we are not the principal supplier of those services. The relevant supplier's own terms and conditions will also apply to your booking.
How to Book: Bookings may be made via our website enquiry forms, by email, by telephone, via WhatsApp, or in person at our offices.
Booking Confirmation: A booking is confirmed only when we have issued a written confirmation and received the required deposit or full payment. We reserve the right to decline any booking at our discretion before confirmation is issued.
Accuracy of Information: You are responsible for ensuring that all passenger names, travel dates, destinations, and other details provided to us are accurate. Errors may result in additional charges from airlines, hotels, or immigration authorities, which will be your responsibility.
Deposits: A non-refundable deposit (typically 30% of the total booking value) is required to confirm most bookings. The exact deposit required will be communicated at the time of booking.
Balance Payment: The remaining balance is typically due 30 days before departure. For bookings made within 30 days of travel, full payment is required at the time of booking. Specific payment deadlines will be stated in your booking confirmation.
Currency: All prices on our website are quoted in US Dollars (USD) unless otherwise stated. Prices are per person sharing unless specifically stated otherwise.
Price Validity: Prices are valid at the time of quotation and are subject to change due to currency fluctuations, fuel surcharges, airline tariff changes, government taxes, or other factors beyond our control. We will notify you of any price changes before your booking is confirmed.
Payment Methods: We accept payment by bank transfer, mobile money (M-Pesa), credit card (where available), and cash at our offices. Full details will be provided with your booking confirmation.
Taxes & Fees: Unless explicitly stated, quoted prices exclude government taxes, park entrance fees, visa fees, airport taxes, travel insurance, and personal expenses. These will be itemised in your final invoice.
All cancellation requests must be made in writing to info@lairseatravel.co.ke. Cancellations take effect from the date we receive written notice. The following cancellation charges apply:
Different cancellation terms may apply to flights, some hotel bookings, and during peak seasons (e.g., Christmas, New Year, wildebeest migration). These will be specified in your booking confirmation.
Amendments: Requests to change travel dates, destinations, or passenger names may be accommodated subject to availability and may incur amendment fees charged by airlines, hotels, or other suppliers in addition to our administration fee.
We reserve the right to cancel any booking in the following circumstances:
If we cancel your booking for reasons other than force majeure or non-payment, we will offer you a full refund or an alternative booking of equivalent value. We are not liable for any additional costs you may incur as a result of such cancellation.
You are solely responsible for ensuring you hold valid travel documents, including:
While we provide visa application assistance as a service, we cannot guarantee visa approval. Refusal of a visa does not entitle you to a refund of any booking costs unless your booking confirmation specifically states otherwise.
We strongly recommend checking entry requirements with the relevant embassy or consulate before booking, as requirements can change without notice.
We strongly recommend that all clients obtain comprehensive travel insurance prior to travel. This should cover at minimum:
Lairsea Travel & Tours does not provide travel insurance. We can assist you in identifying reputable insurance providers upon request. Travel without adequate insurance is at your own risk.
Lairsea Travel & Tours acts as an intermediary between clients and service providers (airlines, hotels, tour operators, visa authorities). We do not own or operate aircraft, vehicles, accommodation, or other travel services.
Our liability for any claim arising from our services is limited to the total amount paid to us for the specific booking in question. We are not liable for:
Nothing in these Terms limits our liability for death or personal injury caused by our own negligence, fraud, or any other liability that cannot be excluded by law.
As a client, you agree to:
We reserve the right to refuse or terminate services for any client whose behaviour is deemed dangerous, illegal, or disruptive, without refund.
"Force majeure" refers to events beyond the reasonable control of either party that make performance of the contract impossible or impractical. These include, but are not limited to: natural disasters, acts of terrorism, war, civil unrest, strikes, epidemics or pandemics, government restrictions on travel, extreme weather events, or actions by government or regulatory authorities.
In the event of force majeure, Lairsea Travel & Tours will not be liable for any losses you incur, but we will make all reasonable efforts to assist you in rearranging or recovering your booking. We recommend comprehensive travel insurance that covers force majeure events.
If you have a complaint during your travel, please inform your guide or the relevant service provider immediately so that steps can be taken to resolve the issue.
If your complaint is not resolved to your satisfaction, please submit it in writing to info@lairseatravel.co.ke within 28 days of returning from your trip. We will acknowledge receipt within 5 business days and aim to provide a full response within 28 days.
Complaints submitted more than 28 days after the return date may not be considered.
These Terms & Conditions are governed by and construed in accordance with the laws of Kenya. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Kenya.
